The Supreme Court decided in Ortega-Rodriguez v. United States that appellate courts could dismiss a fugitive's appeal if the defendant's fugitive status is related to the appellate process. The court ruled that fugitive status which was established prior to the appeal does not necessarily represent grounds for dismissal. However, dismissal would apply if the defendant's ongoing fugitive status disrupted the appellate process.
