A plaintiff can't sue her former employer for an alleged retaliatory failure to rehire her for another position, the 1st Circuit has ruled in affirming a summary judgment.

The plaintiff claimed that when she worked for the defendant's chemical plant, she was sexually harassed by her supervisor and retaliated against for reporting manufacturing problems. She filed suit and continued to work there for a year. She lost her job when the plant closed.
