The Caribbean Court of Justice is a regional tribunal created by the Agreement Establishing the Caribbean Court of Justice (Agreement). (1) It is entrusted with two distinct responsibilities: (1) it is the final court of appeal for consenting parties, (2) and (2) it serves as the original, exclusive, compulsory, and final interpreter of the regional integration treaty, the Revised Treaty of Chaguaramas (3) (Revised Treaty) of the Caribbean Community (CARICOM). In this second, treaty-interpreting role, the Court recently issued its first three jurisdictional decisions. (4) The second and third of those cases raise interesting issues concerning the nature of CARICOM, the requirements for locus standi of persons, and the rules of treaty interpretation as applied to CARICOM treaties.
