Abstract

is study is aimed to analyze the negligent misrepresentation committed by public

ocials. In this sense it provides a general overview of the legal right in forgery and are

analyzed dogmatic and criminal policy point of view related with the understanding of

mens rea of the crime, proposing reasonable guidelines for interpretation. e research,

which faces the subject examined from the legislative Cuban and a recent judgment of the

Cuban Supreme Court, also relies on illustrative jurisprudential pronouncements from the

Spanish Supreme Court.
