The European Court of Justice (ECJ) ruled on March 8, 2012 that pursuant the directive 1999/70/EC the transformation of fixed-term employment contract into unlimited employment contract. In fact the ECJ explained that a Member State may fix in its legislation the transformation of fixed-term employment contract into unlimited employment whereas fixed-term employment contracts may not be reviewed because of the maximal duration has been reached. However, the ECJ ruled that such transformation may not be done with substantial amendment(s) in disfavor of the employee.
