Abstract

e Intellectual Property institutions were created to protect the cultural goods creators,

as long as they ensured the people the access to the culture and knowledge as a human right.

To stimulate the creation of such goods, the state grants to the holders the exclusive right

to exploit their creations for a limited time, after which it return to the public domain from

where they came in the rst place.

Because of the extension in the term of the exploitation monopoly granted for the state in

favor of the owners of the cultural goods, the initial goal got distorted to the extreme of have

formed a barrier which prevents free access to the knowledge.

Underdeveloped countries have identied that their primary exporter economies are not

sustainable in the long run; therefore, they’re ghting for a new international labor division

in conditions of greater equity and less subordination. In that scenario is where the concept

of Knowledge Paradise is conceived, as an analogy of Tax Haven where the capitals ow

in complete freedom; in the Knowledge Paradise, the information must ow freely as well.

e Knowledge Paradise pretends to nd the necessary balance between the need of

stimulates creativity, innovation and venture and the State duty of guarantee the free access

to the knowledge.
