Aumento del volumen de remesas en Nicaragua y regulación aplicable

Según un reporte publicado por el Banco Central de Nicaragua (“BCN”) el 3 de agosto de 2022 el flujo de remesas registrado en el país en el segundo trimestre fue de US$763.6 millones de dólares de los Estados Unidos de América, lo que implica un crecimiento de 44.1% con respecto al mismo trimestre del año 2021.
En el primer semestre del año 2022 ingresaron a Nicaragua un total de US$1,396.2, siendo este monto un 35.5% más alto con respecto al mismo período del año anterior. El informe del tercer trimestre todavía no se ha publicado, pero según las estadísticas mensuales del BCN se puede notar que en los meses de julio y agosto del corriente año el monto de las remesas recibidas aumentó considerablemente con respecto al mismo período del año anterior, siendo en julio y agosto del año 2021 un ingreso de US$351.4 millones y en julio y agosto del año 2022 un ingreso total de US$574.1 millones. El aumento considerable se ha notado en los últimos tres años, en el 2020 ingresaron un total de US$ 1,851.4 millones, en el 2021 ingresaron un total de US$ 2,146.9 millones y en los primeros ocho meses del 2022 un total de US$ 1,970.3 millones.
El 27 de diciembre del año 2019, el BCN publicó la RESOLUCIÓN CD-BCN-LIX-2-19 “Reglamento de los Proveedores de Servicios de Pago de Remesas” que regula la autorización y operación de los servicios que prestan los proveedores de servicios de pago de remesas en la República de Nicaragua. En dicho Reglamento se define a los Proveedores de Servicios de Pago de Remesas como: Persona natural o jurídica que tenga como fin principal o dentro de sus actividades comerciales habituales se dedique a la prestación de servicios de pago de remesas, en sus diferentes modalidades, tanto física como electrónica.
Este Reglamento establece el proceso y los requisitos para la obtención de licencia y registro de personas naturales y jurídicas que deseen ser proveedores de este servicio, así como su proceso de renovación cada 5 años, las obligaciones con las que deben cumplir y las sanciones a las que se enfrentan en caso de incumplimiento. Las instituciones supervisadas por la Superintendencia de Bancos y Otras Instituciones Financieras (“SIBOIF”) y la Comisión Nacional de Microfinanzas (“CONAMI”) no deben de solicitar licencia, pero sí deben registrarse ante el BCN para ofrecer este servicio.
