El pasado 14 de diciembre de 2021 la Cámara de Representantes sancionó el proyecto de ley –previamente aprobado por la Cámara de Senadores– relativa a la modificación del instituto de reducción de donaciones inoficiosas. Resta ahora su promulgación por el Poder Ejecutivo.
Conforme a nuestro sistema, si un sujeto dona bienes afectando las legítimas, las donaciones efectuadas en vida en vida del donante pueden verse comprometidas una vez fallecido el mismo. Y es que los legitimarios forzosos no solo tienen la posibilidad de solicitar la colación de las donaciones en relación al resto de los herederos forzosos, sino que también se encuentran habilitados a reducirlas, planteando la pretensión correspondiente contra los donatarios (sean estos forzosos o no).
