El artículo 869 del Código de Comercio establece que “la ejecución de los contratos celebrados en el exterior que deban cumplirse en el país, se regirá por la ley colombiana”. Es decir, que nuestro ordenamiento jurídico acogió el principio jurídico “lex loci solutions” y por eso, incluso en los contratos celebrados en el exterior, sin importar si las partes son extranjeras o colombianas y que se deban ejecutar en Colombia, la ley aplicable es la colombiana.
