La igualdad del tratamiento de los acreedores en el concurso preventivo y la quiebra

Según dispone el artículo 32 de la Ley de Concursos y Quiebras (“LCQ”), todo acreedor anterior a la presentación en concurso preventivo tiene que solicitar el reconocimiento de su crédito ante el síndico del concurso, aun cuando se trate de un organismo de carácter público.
Muchas veces el Fisco intentó soslayar esa carga ineludible de todo acreedor, con el argumento de que es el síndico quien tiene la obligación de completar el formulario N° 735 (Resolución General AFIP N° 1975/2005), destinado a comunicar a la autoridad fiscal la apertura del concurso y de las deudas fiscales de la persona o sociedad concursada.
Sin embargo, la jurisprudencia y doctrina hoy coinciden en que el Fisco tiene la carga de informar su crédito ante el síndico del concurso como cualquier otro acreedor (por ejemplo, CNCom, Sala E, 22/9/1982, en “Fisco Nacional c/ Hijos de Ybarra Argentina SA s/ concurso”, Lexis Nexis 11/10784).
Tanto la doctrina como la jurisprudencia coinciden, como regla, en que el tributo liquidado en los procedimientos de determinación de oficio (con base real o presunta) configura causa suficiente para obtener el reconocimiento de sus créditos, sin necesidad de ahondar en la comprobación de la causa (por ejemplo, CNCom.
