Como es sabido, mediante la firma de capitulaciones matrimoniales, antes o durante el matrimonio, se puede pactar la renuncia de los conyugues al derecho de participar en la mitad del valor neto de los bienes gananciales constatados en el patrimonio del otro. Dicho derecho aplica para las uniones de hecho, según lo dispuesto mediante resolución de la Sala Constitucional N° 13920 del 9 de junio de 2023.
