En 2018, la Ley de Marcas –Ley n.° 22362–incorporó la caducidad parcial de marca en la Argentina, que entrará en vigor a partir del 12 de junio de 2023. Su objetivo es que el registro de una marca también pueda caducar únicamente en relación con determinados productos o servicios para los que esta no haya sido utilizada en los cinco años previos a solicitar su caducidad. Asimismo, la norma plantea que las marcas sujetas a caducidad deben haber estado registradas por más de cinco años –esto también incluye las renovaciones–.
