¿Los mensajes de WhatsApp sirven para fundamentar un despido?

El artículo 478 del Código de Trabajo establece la obligación del patrono de probar y demostrar cuáles fueron las razones que conllevaron al despido de un trabajador. Además, indica que estas deben ser justificadas, razonables y amparadas al marco normativo laboral.

Ahora bien, de conformidad con el numeral 479 del Código de Trabajo, “puede ofrecerse todo medio probatorio que sirva a la convicción del tribunal, admisible en derecho público y común, siempre que no esté expresamente prohibido ni sea contrario al orden público o a la moral”.

Lo anterior quiere decir que en los procesos judiciales laborales en los cuales se discute la procedencia de un despido existe una libertad probatoria para que las partes demuestren los hechos y argumentos alegados, esto mediante cualquier medio de prueba que consideren pertinente, siempre y cuando no contravengan las limitaciones indicadas en dicho artículo.

En la actualidad, las plataformas de mensajería y otras redes sociales se han convertido en herramientas muy frecuentes y eficientes para la comunicación. Posiblemente la más popular entre todas ellas sea la aplicación WhatsApp. Mediante dicha plataforma de mensajería se envían y reciben mensajes, e incluso se realizan llamadas mediante Internet, casi de manera instantánea.

A simple vista, los mensajes de WhatsApp, ya sean de texto o multimedia (fotografías, videos o audios), podrían ser un elemento de prueba fácilmente admisible en un proceso en el cual se discuta la fundamentación de un despido. Sin embargo, existe una serie de restricciones para su admisión, en especial por la forma en que se obtienen dichos mensajes; además, hay otras limitantes ligadas al derecho a la intimidad de cada persona y a la inviolabilidad de las comunicaciones.

WhatsApp es un sistema de mensajería disponible para teléfonos celulares e incluso computadoras; por lo general, tales dispositivos son de uso personal. Ese mismo carácter íntimo abarcaría a dicha herramienta de comunicación. El contenido que ahí se incluya es privado y corresponde a cada propietario (tanto del aparato electrónico como de la información que ahí se contiene) determinar a cuáles personas puede permitir el acceso. Este derecho se respalda en el artículo 24 de la Constitución Política y en el artículo 11 de la Convención Americana sobre Derechos Humanos.
