Pensión familiar
La pensión familiar, que sigue el principio de la integralidad y de la solidaridad en sistema, está normativizado por la Ley 1580 de 2012 y reglamentado por el Decreto 288 de 201.
La Ley 1580 de 2012 establece que si ningún cónyuge o compañero permanente alcanza a pensionarse por no cumplir con los requisitos necesarios, ambos podrán unir fuerzas y lograr, sumando las cotizaciones de los dos, una pensión de vejez equivalente a 1 salario mínimo legal mensual vigente (no puede ser superior).
Se debe acreditar más de cinco años de relación conyugal o convivencia permanente iniciada antes de que cada uno de los cónyuges o compañeros cumpliera 55 años de edad.
La pensión familiar puede otorgarse en cualquiera de los dos regímenes pensionales: RAIS o Régimen de prima media.
