En los inicios de la normatividad relacionada con los riesgos en el trabajo (1915) se indicaba que si había fuerza mayor, no debía el empleador pagar, pues no era su culpa.
Posteriormente, en 1950 el Código Sustantivo del Trabajo (CST) se elimina la causal de exoneración y se establece que el empleador era siempre responsable, aún en caso de fuerza mayor.
En la actualidad se continúa por esta dirección y si sucede un accidente producido por ejemplo, durante el horario laboral o en el lugar de trabajo, será considerado accidente de trabajo, así sea como consecuencia de un terremoto, alud, ataque...
