Saskatchewan Court Of Appeal Confirms That Emails Can Extend Limitation Periods Under The Limitations Act

Earlier this year, we wrote here about the decision in I.D.H. Diamonds NV v Embee Diamond Technologies Inc., 2017 SKQB 79, where Mr. Justice Layh held:

1. that the sort of informal email discussions that are commonplace in today's business communications can be relied on as an acknowledgement of a debt, so as to extend a limitation period under Saskatchewan's The Limitations Act (the "Act"), even if the debt is not expressly referenced in many of the communications; and
