En los autos “Barral de Keller Sarmiento, Graciela vs. Guevara, Juan Antonio y otros s/ daños y perjuicios”, el 2 de mayo de 2006 la sala C de la Cámara Nacional de Apelaciones en lo Civil resolvió la invalidez de la cláusula “claims made” pactada en un seguro de responsabilidad profesional para médicos.
El demandado -condenado por mala praxis médica- había citado a Florencia Compañía de Seguros Generales S.A. (absorbida por La Ibero Platense Compañía de Seguros S.A.) para que cubra su responsabilidad, en los términos del seguro contratado por la Asociación de Médicos Municipales, de la que el demandado era miembro.
La aseguradora declinó la cobertura del evento invocando la cláusula “claims made”. Según la aseguradora, la póliza la obligaba a mantener indemne a los profesionales que integraban la Asociación de Médicos...
