The Prisoner, Komai Balal, after a trial, was found guilty on one count of rape. On 22 March 2004, the Prisoner, at Jelso, Madang, committed rape, upon Jacobeth Komai, who is his own daughter.

The Prisoner, on 21 March 2004, approached the victim in his house wanting to have sexual intercourse with her. The victim disapproved of the Prisoner's incestuous attitude so she left and spent the night at her aunt's house. On Monday 22 March 2004, the Prisoner went to the aunt's house to see the victim. Upon sighting the Prisoner, the victim wanted to run and hide but was ordered to stop by the Prisoner. The Prisoner then proceeded to assault her.
