Kirriwom J: This is an application for default judgment to be entered against the Defendants for failing to file their Defence within time. There is no question about the notice being given by the acting Solicitor–General of his intention to defend this action. This was filed on 10 May 1999. The Defendants were required to file their Defence by 13 July 1999 but they failed to do so until 3 August 1999. At the time this application was pursued the Defendants' Defence was already registered with the Court.
