Arbitraje de amigables componedores vs. arbitraje de derecho

En junio de 2007 la Sala B de la Cámara Nacional de Apelaciones en lo Comercial declaró inadmisible un recurso de queja interpuesto como consecuencia de la denegatoria por el Tribunal de Arbitraje General de la Bolsa de Comercio de un recurso de apelación contra el laudo dictado en el caso Mahle de Argentina S.A. v. Carleti, Alfonso[1]. La queja no prosperó ante el impedimento que tuvo la Sala B de verificar si el laudo había sido dictado en un arbitraje en derecho o de amigables componedores, al no haber acompañado el recurrente el compromiso arbitral.

El Tribunal Arbitral fundó el rechazo de la apelación en la irrecurribilidad de los laudos dictados en arbitrajes de amigables componedores, los que revisten esa modalidad tanto por pacto expreso como por silencio de las partes respecto de la clase de arbitraje a la que se someten, conforme lo dispuesto en el Reglamento de esa institución arbitral (artículos 64 y 2). Como es sabido, contra un laudo de amigables componedores lo único que cabe es la acción de nulidad y no el recurso previsto en el artículo 760 del Código Procesal Civil y Comercial de la Nación (CPCC).

Esta variante de sujeción al arbitraje de amigables componedores por no especificar la modalidad elegida se encuentra también prevista en el Reglamento del Tribunal de Arbitraje General de la Bolsa de Comercio de Rosario (artículo 2), en el CPCC (artículo 766, 2° párrafo) y en los Códigos Procesales provinciales, con excepción del de la Provincia de Río Negro (artículo 741).
