Aspectos relevantes sobre el nuevo régimen satelital en Colombia

La Resolución 0376 de 2022 de MinTIC establece un nuevo modelo para la prestación de los servicios satelitales en Colombia y actualiza los parámetros para calcular la contraprestación por el uso del espectro asociado a comunicaciones por satélite. El fin de esta nueva normatividad según el MinTIC es generar estímulos a la inversión y el uso de la tecnología satelital para mejorar la conectividad en el país, en especial en sus zonas más apartadas.
- ¿A quién aplica el nuevo régimen satelital?
Aplican a las personas que requieran usar el espectro radioeléctrico asociado a los servicios de radiocomunicaciones por satélite en Colombia a través de estaciones terrenas. Las personas deben encontrarse previamente incorporadas en el Registro Único de TIC como Proveedor de Redes y Servicios de Telecomunicaciones (en adelante PRST).
Si la persona hace uso de enlaces ascendentes de frecuencia (Tierra a Espacio) deberá solicitar un permiso para el uso del espectro radioeléctrico. En contraposición, si la persona solo hace uso de enlaces descendentes (Espacio a Tierra), es decir, solo hace recepción, no requerirá dicho permiso, salvo que la persona considere que el MinTIC y la Agencia Nacional del Espectro (ANE) deba conocer sobre dicha recepción en los procesos de gestión del recurso.
- ¿Cuáles son las principales características del nuevo régimen satelital?
- Plantea un modelo de gestión del espectro radioeléctrico satelital del segmento terreno, derogando la Resolución 106 de 2013 cuyo modelo se basaba en los servicios satelitales asociados al segmento espacial.
- Se crea un permiso asociado a los servicios de radiocomunicaciones por satélite a través de estaciones terrenas otorgado por el MinTIC, el cual podrá ser obtenido si el PRST se encuentra autorizado por el operador satelital, o una persona jurídica autorizada por este, para acceder a las frecuencias del segmento espacial.
- Se elimina el registro de proveedor de capacidad satelital.
- Los satélites deben estar registrados en la Lista Andina Satelital de la Comunidad Andina de Naciones. No cambia el régimen comunitario.
- Para obtener el permiso, el proveedor deberá diligenciar los formatos de solicitud del espectro definidos por el MinTIC, anexando la información técnica pertinente y escogiendo el tipo de permiso requerido, el cual se define conforme a la topología de la red de las estaciones terrenas.
