Autoridad de aplicación de la Ley de Defensa del Consumidor respecto de órganos del Estado Nacional

La Corte Suprema de Justicia de la Nación en un reciente y novedoso fallo (“Banco de la Nación Argentina c/ Programa de Defensa del Consumidor, Comercio y Cooperativas de la Provincia de San Luis” del 28 de julio de 2005) estableció que las autoridades provinciales no tienen competencia para imponer sanciones a órganos dependientes del Estado Nacional.
En el caso, el Programa de Defensa del Consumidor, Comercio y Cooperativas de la Provincia de San Luis impuso al Banco de la Nación Argentina (BNA) una multa de $ 500.000 por una supuesta infracción a los artículos 4 y 19 de la Ley de Defensa del Consumidor Nº 24.240 (LDC).
El BNA había apelado la decisión del organismo provincial en exceso del plazo de 5 días que establece el ordenamiento procesal local aunque dentro del plazo de 10 días hábiles que prevé el artículo 45 de la LDC para los casos en que la sanción es dispuesta por la autoridad nacional de aplicación.
El ente administrativo local, quien debía conceder el recurso, rechazó por extemporánea la apelación y confirmó la multa impuesta al BNA. Esto motivó que el BNA interpusiera un recurso de queja por apelación denegada ante la Cámara Federal de Apelaciones de Mendoza, el cual fue desestimado bajo el argumento de que el procedimiento local era legítimo y, consecuentemente, el recurso de apelación deducido por el BNA resultaba extemporáneo en los términos de la legislación procesal provincial.
Disconforme, el BNA interpuso recurso extraordinario federal con fundamento principal en que el decisorio recurrido prescindió de considerar que en virtud del artículo 27 de la Carta Orgánica del BNA (Ley Nº 21.799) la entidad bancaria debía quedar exclusivamente sometida a la jurisdicción y competencia federal.
En oportunidad de entender en el recurso extraordinario interpuesto por el BNA, la Corte Suprema de Justicia de la Nación –por mayoría, y adhiriendo al dictamen del procurador fiscal– declaró procedente el recurso extraordinario y dejó sin efecto la sentencia apelada ordenando que el tribunal de origen dicte un nuevo fallo con arreglo a los argumentos expuestos en el decisorio de autos.
