La Cámara Comercial rechazó la posibilidad de notificar una demanda en el domicilio “especial” con carácter de “constituido”

En los autos caratulados: “Alba Cía. Argentina de Seguros S.A. c/ Maiolo Julio Cesar y otro s/ ordinario”, la Sala A de la Cámara Nacional de Apelaciones en lo Comercial confirmó la sentencia de primera instancia y negó al actor la posibilidad de notificar su demanda en el domicilio “especial” -pactado con los demandados en un contrato de seguro de caución en el que las firmas de las partes habían sido certificadas por escribano público- con el carácter de constituido.
El principio general que establece nuestro derecho procesal obliga al actor a notificar la demanda por cédula en el domicilio real. Excepcionalmente, con base en lo dispuesto en el último párrafo del artículo 40 del Código Procesal Civil y Comercial de la Nación (CPCCN) y en el artículo 1028 del Código Civil, la jurisprudencia admite que el traslado de la demanda se practique en el domicilio “especial” o “contractual” siempre y cuando haya sido pactado en un instrumento público o en uno privado con firmas certificadas por escribano.
La particularidad de este caso radica en que la actora no sólo pretendía notificar la demanda en el domicilio “especial” sino que además pretendía darle a ese domicilio el carácter de “constituido” y no de “denunciado”.
La diferencia no es menor ya que atribuir a dicho domicilio el carácter de constituido habría relevado al oficial notificador de cumplir con el procedimiento especialmente concebido en los artículos 339 y 141 CPCCN para la notificación de demandas. Allí se dispone que, si el demandado no estuviera presente en el lugar, se le dejará aviso para que espere al día siguiente y si tampoco entonces se hallare, la demanda será entregada a otra persona de la casa o será fijada en la puerta de acceso.
La Cámara no convalidó esta pretensión y señaló que, por tratarse de la diligencia para notificar la demanda, no resultaba procedente otorgar el carácter de “constituido” al domicilio “especial” pactado contractualmente.
