CORTE SUPREMA ENVÍA AL SENADO INFORME SOBRE PROYECTO DE LEY QUE MODERNIZA LEGISLACIÓN BANCARIA

Reunido el tribunal pleno de la Corte Suprema –el viernes 17 de agosto recién pasado– analizó el proyecto de ley que moderniza la legislación bancaria. Informe que fue remitido hoy –lunes 20– al presidente de la Comisión de Hacienda del Senado, Juan Pablo Letelier, con la opinión del máximo tribunal del país sobre las modificaciones realizadas por la Cámara a la iniciativa legal informada con anterioridad.
“(…) en lo que se refiere a la modificación de la regla de competencia relativa, la supresión de la regla de competencia forzada de los tribunales de Santiago parece proporcional y de toda lógica, tal como se manifestó en el informe original de la Corte. En este sentido, además de las consideraciones de acceso a la justicia y derecho a defensa que se hicieron en el informe original, debe tener en cuenta que resulta del todo razonable que el juicio ejecutivo deba promoverse en el lugar en el que debió hacerse el pago (art. 59 de la Ley N° 21.000), y no en otro lugar distinto. Por tanto, ha de valorarse muy positivamente el acogimiento de las observaciones planteadas por la Corte Suprema con anterioridad en orden a mejorar la iniciativa en este punto”, sostiene el informe.
El oficio agrega que: “en lo relativo a la mantención de la regulación vigente de la ley N° 21.000, es menester hacer presente que ella podría resultar observable en la medida que el inciso segundo del artículo 59 propuesto por la iniciativa considera firme la resolución de la Comisión desde el rechazo total o parcial de los recursos de reposición y reclamación, pues en concordancia con lo señalado en el primer inciso de la misma disposición -que indica que la multa deberá ser pagada dentro diez días, contado desde que la resolución del Consejo se encuentre firme- podría llegar a considerarse que se constituye una regla de solve et repete, de facto.
