CS condena a empresa de venta de tickets por cláusula abusiva

En fallo unánime, la Corte Suprema condenó a Ticketmaster S.A. a pagar una multa de 100 UTM y le ordenó devolver los importes por cobro de servicios de espectáculos cancelados.
La sentencia sostiene que la disposición estimada abusiva está contenida en los boletos o tickets que la demandada comercializa con el público interesado en concurrir a espectáculos que una productora presenta. Su tenor es el siguiente: “En caso de cancelación o posposición del evento, el precio establecido en este boleto, con exclusión de los cargos por servicio y por envío, si los hubiere, será reembolsado contra su presentación, en el lugar de su adquisición, a partir de las 48 horas siguientes de la fecha de aviso de cancelación o posposición”. En virtud de tal estipulación Ticketmaster S.A. impone a los consumidores asumir la pérdida de esa parte del precio pagado al adquirir las entradas llamada “cargo por servicio”.
La resolución agrega que la demandada manifiesta que este cobro está referido al servicio que la empresa presta a los clientes como intermediaria en la adquisición de las entradas a espectáculos organizados por una productora. Así, la discusión radica en determinar si es procedente que la demandada retenga ese valor en la hipótesis de suspensión o cancelación del evento.
A continuación, el fallo señala que la cláusula transcrita y su contraste con lo dispuesto en el artículo 16 letra g) de la ley citada se puede apreciar que se trata de una cláusula que causa en perjuicio del consumidor un desequilibrio importante en los derechos y obligaciones que para las partes se derivan del contrato ya que impone a éste la carga de soportar la pérdida de parte del precio de la venta de entrada a un evento que no se realiza, hecho respecto del cual el consumidor no tiene ninguna injerencia o responsabilidad; la demandada percibe, pues, ese valor mientras el consumidor nada recibe a cambio. En estas condiciones, es la parte más débil de la relación de consumo la que resulta gravada o afectada objetivamente pues no recibió el servicio esperado con la contratación.
Luego añade que la demandada sostiene que esa suma la percibe como intermediario y no pertenece al organizador y que, por otra parte, el servicio de venta de la entrada fue prestado.
