La elección de la sede arbitral y los intentos de interferencia judicial

El 17 julio de 2008 la Sala IV de la Cámara Nacional de Apelaciones en lo Contencioso Administrativo Federal se declaró competente para entender en el recurso de nulidad que el Estado Nacional Argentino (EN) interpuso con los autos “EN - Procuración del Tesoro c/ Cámara de Comercio Internacional (DECI 15-XII-05) s/ proceso de conocimiento"[1] .
La nulidad se había planteado en junio de 2007 cuando la Corte de Arbitraje Internacional de la Cámara de Comercio Internacional (ICC) rechazó el pedido de recusación contra el árbitro Rigo Sureda, en el arbitraje de inversiones “National Gris Transco plc (Reino Unido) v. República Argentina (Argentina) UNC 72/CCO”, en trámite ante el CIADI y bajo las reglas UNCITRAL. En esa ocasión, el EN solicitó también a la Justicia que ordenara la suspensión del arbitraje hasta tanto se resolviese su planteo, medida cautelar que fue concedida por la Sala IV el 3 de julio de 2007.
Sin embargo, por ser Washington la sede elegida por las partes para tramitar el arbitraje, la Sala IV carecía de competencia para decidir la suspensión de un trámite que se desarrolla en aquella ciudad ni tampoco el derecho procesal argentino era el aplicable al planteo del EN. En consecuencia, el arbitraje siguió su curso normal, a pesar de la orden judicial argentina de suspensión que, como era de esperar, no resultó imperativa en Washington.
Este año se reiteró la interferencia judicial al admitir la Sala aludida su competencia para entender en el recurso de nulidad e insistir, bajo apercibimiento de aplicar astreintes, una suspensión del proceso arbitral que continúa tramitando en Washington.
