Las horas extras en el contexto del trabajo remoto

El 1 de noviembre de 2020 se publicó en el diario oficial El Peruano el Decreto de Urgencia N° 127-2020, mediante el cual se prorrogó la vigencia del trabajo remoto hasta el 31 de julio de 2021, incorporándose como obligación del empleador observar las disposiciones sobre la jornada máxima de trabajo y respetar el derecho a la desconexión digital de los trabajadores.
Con ello surge una serie de interrogantes sobre la contrapartida de la jornada ordinaria, que es el trabajo en sobretiempo u horas extras ¿El derecho a la desconexión digital podría evitar que el trabajador realice horas extra en cualquier circunstancia? ¿Cómo el empleador puede evitar que se realicen horas extras en el contexto del trabajo remoto? ¿Qué actividad probatoria se debe llevar a cabo para acreditar las horas extras?
Las respuestas a las interrogantes planteadas no las podemos encontrar en la normativa sobre trabajo remoto regulada en el Decreto de Urgencia N° 026-2020 (Título II) y en el Decreto de Urgencia N° 127-2020 (única disposición complementaria modificatoria), debido a que existe una regulación mínima sobre este nuevo régimen que ha surgido en el contexto del estado de emergencia.
Por ello, proponemos abordar estos temas a partir del Decreto Legislativo N° 854 (Ley de Jornada de Trabajo, Horario y Trabajo en Sobretiempo), sus normas vinculadas y pronunciamientos de la Corte Suprema, a efectos de suplir los vacíos normativos.
En primer lugar, la desconexión digital no podría ser concebido como un derecho absoluto de los trabajadores, puesto que el artículo 9° del Decreto Legislativo N° 854 ha previsto que se puede realizar trabajo en sobretiempo cuando resulte indispensable a consecuencia de un hecho fortuito o fuerza mayor que ponga en peligro inminente a las personas o bienes del centro de trabajo o la continuidad de la actividad productiva.
En segundo lugar, el artículo 7° del Decreto Supremo N° 004-2006-TR requiere al empleador que adopte las medidas suficientes para facilitar el retiro inmediato de los trabajadores del centro de trabajo una vez cumplido el horario de trabajo. Sin embargo, sería irrazonable exigir esta obligación en el contexto del trabajo remoto, pues la prestación de servicios se ha traslado del centro de trabajo al hogar de los trabajadores, lo que dificulta que el empleador tenga un total dominio del trabajo en sobretiempo, más allá de evitar realizar coordinaciones fuera del horario de trabajo y otorgar un plazo razonable para el...
