1. Introducción
La administración de De la Rúa emitió una serie de reglamentaciones mediante las que se restringió el retiro de depósitos (el “corralito”). Dichas restricciones fueron acrecentadas por las posteriores administraciones, las que también decretaron la reprogramación de los depósitos.
La Ley Nº 25.561 de Emergencia Pública y Reforma del Régimen Cambiario (la “Ley de Emergencia”), abandonó el tipo de cambio fijo de 1 Peso por 1 Dólar estadounidense establecida por la Ley de Convertibilidad Nº 23.928, con sus modificaciones. De acuerdo con la Ley de Emergencia, ciertas obligaciones denominadas en moneda extranjera fueron “pesificadas”.
Los depositantes invadieron los tribunales con amparos, solicitando el dictado de medidas cautelares mediante las que los jueces ordenaban la devolución de su dinero a los depositantes en la moneda en que se realizaron los depósitos o el equivalente en pesos de dicho monto al tipo de cambio vigente en el mercado.
El Decreto Nº. 214/2002, con sus modificaciones, extendió la “pesificación” de la economía, y estableció la suspensión por el plazo de 180 días de todos los procesos judiciales que objetaran la validez del “corralito” o de la “pesificación”.
La Corte Suprema de Argentina, en el caso Smith, declaró la inconstitucionalidad del “corralito”, al tiempo que la suspensión de los procesos judiciales era considerada inconstitucional por los tribunales inferiores.
El 25 de abril de 2002, el Congreso sancionó la Ley Antigoteo, en un intento por limitar las medidas precautorias que los tribunales pueden otorgar, estableciendo entre otras normas que las medidas cautelares no pueden ser otorgadas si tienen el mismo efecto práctico que el fallo final.
