La accionante, para fundar su pretensión, invocó la titularidad sobre las marcas “SAFYBI” y “EXPOFYBI” en las clases 35, 41, 42 y 44, y su confundibilidad con la sigla “SAFYB” utilizada por el Sindicato.
El tribunal de primera instancia, previa caución juratoria de la actora, concedió la medida y ordenó el cese de uso de la sigla “SAFYB” en todas sus formas.
Planteada la revocatoria con apelación en subsidio por la demandada, la causa pasó a la Cámara tras que el magistrado a quo mantuviera su criterio.
