Minsalud fijará unilateralmente precio de medicina para la leucemia

Todo parecía que la declaración de la molécula Imatinib para tratar el cáncer como un asunto de interés público, sería el tercer caso de Licencia Obligatoria que tendríamos en Latinoamérica, luego de que los Gobiernos de Brasil y de Ecuador hicieron uso de esta facultad en el pasado.
Si recordamos, el año 2007 el Gobierno Brasilero concedió una licencia obligatoria para la fabricación del antirretroviral efavirenz, cuya patente pertenece a Merck Sharp & Dohme. Por su parte, el año 2010 el Gobierno del Ecuador concedió una licencia obligatoria que permitía la importación del medicamento antirretroviral ritonavir a la farmacéutica india CIPLA fabricante medicamentos genéricos, cuyo titular de la patente es Abbott.
Siendo un requisito previo a la Licencia obligatoria en la mayoría de las legislaciones que contemplan éste derecho, al igual que lo que ha sucedido en Colombia con la molécula Imatinib para tratar el cáncer, tanto en el caso de Brasil y de Ecuador se negoció previamente y sin éxito con los titulares de las respectivas patentes, para bajar los precios, con el argumento de facilitar el acceso el medicamento a la mayoría de la población, dado su elevado precio.
Sin embargo, en este caso, luego de que fracasó la negociación con el laboratorio suizo Novartis, el Ministerio de Salud de Colombia ha decidido no otorgar la Licencia obligatoria a otro(s) fabricante(s) del medicamento, o que permita la importación de un genérico del mismo principio activo del medicamento a un Laboratorio extranjero, sino que ha decidido fijar el precio de venta del medicamento por medio de un acto administrativo para que la Comisión Nacional de Precios de Medicamentos y Dispositivos defina de manera unilateral...
