Nicaragua: La influencia de la Propiedad Intelectual y los desafíos que enfrenta.

Cada 26 de abril se celebra mundialmente el día de la Propiedad Intelectual. Esta celebración se instauró oficialmente en el año 2000, sin embargo, su razón de ser, data de mucho antes.
La celebración fue decretada por las Naciones Unidas y se destinó particularmente el día 26 de abril tomando en consideración la fecha en que entró en vigor el Convenio de la OMPI, instrumento internacional por medio del cual nació oficialmente en 1970 la Organización Mundial de la Propiedad Intelectual. Cabe destacar que, si bien se retomó la fecha de la entrada en vigor, el Instrumento mencionado vio por primera vez la luz en forma de acuerdo en el año 1967, y según afirma la OMPI en sus notas históricas informativas, fue el fruto de cinco semanas de ardua negociación durante una conferencia que se celebró en los salones del Parlamento sueco en Estocolmo.
Durante todos sus años de trayectoria, la OMPI ha trabajado arduamente para desarrollar un sistema internacional de Propiedad Intelectual que fomente la innovación, la creatividad y el acceso equitativo a los beneficios de esta. Esto es congruente con esta fundamental celebración, la cual desde sus inicios ha tenido como principal motivación destacar la importancia de la Propiedad Intelectual en el mundo moderno, creando conciencia sobre la relevancia de proteger las creaciones del intelecto humano a través de los derechos de autor, así como también para hacer énfasis en el respeto y difusión de los derechos comprendidos por la Propiedad Intelectual.
Acorde con el propósito de la celebración, en este breve artículo te compartiremos nociones sobre la influencia/presencia de la Propiedad Intelectual en determinada industria, y también haremos referencia a algunos desafíos que enfrenta y enfrentará en los años venideros, como resultado de los avances tecnológicos del ser humano.
Para ello hemos tomado de referencia la industria del Deporte, y en cuanto a los desafíos, hemos tomado como referencia la Inteligencia Artificial.
Propiedad Intelectual. en el Deporte
La Propiedad Intelectual (PI) es un aspecto importante de la industria del deporte ya que proporciona un marco jurídico que permite a los equipos deportivos, los atletas y las organizaciones deportivas proteger sus derechos e intereses comerciales. Las marcas, las patentes, derechos de autor y derechos conexos son los principales tipos de derechos de PI que se utilizan habitualmente en la industria del deporte.
Al margen que la legislación particular de cada jurisdicción puede variar, es válido afirmar que las marcas son el elemento de Propiedad Intelectual que más comúnmente presenciamos en el deporte. El tenis, el boxeo, el fútbol, futbol americano, el básquetbol, el beisbol y los deportes automotores, por mencionar algunos, todos tienen de por medio la protección de marcas (y otros signos distintivos) y el uso de estas, bien sea por terceros autorizados o por sí mismos.
Las marcas, emblemas, nombres comerciales y slogans o señales de propaganda les permiten a las federaciones/asociaciones, organizaciones deportivas (clubes) e incluso a los propios atletas que desarrollan el deporte, principalmente: explotar comercialmente aquello que los identifica, y al mismo tiempo, entablar acciones contra aquellos no autorizados que buscan obtener algún beneficio económico en detrimento del derecho de estos, confundiendo o engañando al público consumidor.
