Nueva regulación para empresas proveedores de tecnología financiera en Nicaragua

El 27 de abril del presente año entró en vigencia el “Reglamento de los Proveedores de Tecnología Financiera de Servicios de Pago y Proveedores de Servicios de Activos Virtuales” (“Reglamento”), emitido por el Banco Central de Nicaragua (“BCN”) mediante resolución número CD-BCN-XXV-1-22, que reemplazó al “Reglamento de Proveedores de Servicios de Tecnología Financiera de Servicios de Pago” publicado en septiembre del año 2020 y sus reformas.
A partir de la entrada en vigencia del primer Reglamento (2020) hasta la fecha, se han registrado ante el BCN aproximadamente 12 instituciones como Proveedores de Tecnología Financiera de Servicios de Pago (“PSP”). Entre ellos se encuentra la mayoría de los bancos autorizados para operar en el país y empresas Fintech, que ofrecen servicios de pago tales como carteras digitales, puntos de ventas móviles, dinero electrónico, servicio de compraventa e intercambio de divisas de forma electrónica, servicio de transferencia de fondos y/o pasarelas de pago online.
Con la publicación de este nuevo Reglamento también se deberán registrar y solicitar licencia ante el BCN los Proveedores de Servicios de Activos Virtuales (“PSAV”) que realicen una o más de las siguientes actividades u operaciones para o en nombre de otra persona natural o jurídica: intercambio entre activos virtuales y monedas fíat, intercambio entre una o más formas de activos virtuales, transferencia de activos virtuales, custodia y/o administración de activos virtuales o instrumentos que permitan el control sobre activos virtuales y participación y provisión de servicios financieros relacionados con la oferta de un emisor y/o venta de un activo virtual.
Las licencias otorgadas a estos proveedores tienen una vigencia indefinida y no pueden ser cedidas, transferidas o enajenadas a terceros, así como tampoco podrán ser otorgadas en garantía. Las instituciones financieras supervisadas y reguladas por la Superintendencia de Bancos y Otras Instituciones Financieras (“SIBOIF”) y por la Comisión Nacional de Microfinanzas (“CONAMI”) que presten servicios como PSP y los bancos sujetos a supervisión y regulación de la SIBOIF que presen servicios como PSAV no requerirán realizar el trámite de solicitud de licencia ante el BCN; sin embargo, éstos deberán registrarse ante el BCN y estarán sujetos a las demás disposiciones establecidas en el Reglamento.
