Pedido de painel contra UE na OMC volta à pauta
A regulamentação das atribuições da Secretária-Executiva da Câmara de Comércio Exterior (Camex), que estava em um limbo jurídico desde o início do ano, animou a indústria exportadora de carne de frango. A Associação Brasileira de Proteína Animal (ABPA) reiterou ao governo o pedido para a abertura de um contencioso contra a União Europeia na Organização Mundial de Comércio (OMC).
Na prática, os exportadores brasileiros questionam o critério sanitário aplicado pela União Europeia para a carne de frango salgada, principal produto exportado pelo Brasil. Segundo a advogada Ana Caetano, do escritório Veirano Advogados, desde 2011 o bloco europeu exige que o frango salgado não tenha qualquer tipo de salmonela, mas sem base científica para tal.
Atualmente, o Brasil conta com uma cota de cerca de 170 mil toneladas para exportar carne de frango salgada à União Europeia. Dentro desse cota, a tarifa de importação é menor, de 15,4%, de acordo com Ana Caetano, que representa a ABPA. A vantagem tarifária faz com que os exportadores brasileiros prefiram exportar frango com sal. Se fossem exportar a carne de frango in natura, teriam de pagar uma tarifa "impeditiva" de 1.024 por tonelada, conforme a advogada.
O problema é que, para os europeus, o frango salgado não poder ter qualquer um dos mais de 2,5 mil tipos de salmonelas, ao passo que o produto in natura só não é barrado se tiver dois tipos da salmonela (typhimurium e enteritidis), justamente os mais associados à intoxicação alimentar.
A argumentação brasileira é que o frango salgado deveria ter o mesmo critério do frango in natura, já que ambos não são cozidos e, portanto, não podem evitar a bactéria. O processo de cozimento mata as salmonelas. Além disso, acrescentou Ana Caetano, o frango salgado exportado pelo Brasil seria destinado para a indústria de processamento europeia. Assim, seria cozido antes de chegar ao consumidor.
