¿Pueden los funcionarios bloquear a sus críticos en sus redes?

Cada vez es mayor el número de empleados oficiales que utilizan las redes sociales para expresar opiniones o anunciar a la ciudadanía los proyectos y políticas relacionadas con las entidades a su cargo.
Lo anterior lleva a preguntarse, si cuando estos funcionarios incluyen contenido, en sus plataformas, relacionados con asuntos oficiales les conciernen, están actuando en desarrollo de sus funciones o a título personal y si en ese caso su derecho a la intimidad está por encima de la libertad de expresión de los ciudadanos.
Este debate ha cobrado especial vigencia en los Estados Unidos a raíz de diversas acciones legales instauradas, por algunos ciudadanos, contra funcionarios oficiales, que los bloquearon en sus redes sociales por criticar el desempeño de sus funciones.
Los demandantes alegaron que esta práctica violaba sus derechos otorgados por la Primera Enmienda de la Constitución, que protege la libertad de expresión, pero las cortes de apelación que conocieron estos litigios expidieron decisiones diametralmente opuestas.
Una de esas demandas fue instaurada contra dos miembros de una junta escolar del sur de California, Michelle O’Connor-Ratcliff y TJ Zane. Ambos bloquearon a Christopher y Kimberly Garnier, padres de estudiantes de ese distrito y críticos habituales en sus cuentas de redes sociales.
Otra se dirigió contra a James Freed, administrador de la ciudad de Port Huron, Michigan, quien bloqueó a Kevin Lindke de su página personal de Facebook, debido a sus críticas sobre las restricciones en la ciudad por la pandemia.
En este último caso, la Corte de Apelaciones del Sexto Circuito de EE. UU. determinó que Freed no violó los derechos de Lindke por cuanto Freed había actuado a título personal.
Sin embargo, en el primer litigio, la Corte de Apelaciones del Noveno Circuito de EE. UU. adoptó una decisión opuesta al sostener que cuando los funcionarios públicos tengan páginas de redes sociales...
