Regulación migratoria en El Salvador frente a las oportunidades de inversión que abrió la Ley Bitcoin

Tras la aprobación, publicación y entrada en vigencia de la “Ley Bitcoin” muchas interrogantes y dudas han surgido para inversionistas tanto salvadoreños como extranjeros; esto debido a que El Salvador es el primer país en implementar esta criptomoneda como moneda de curso legal junto con el colón salvadoreño y el dólar estadounidense.
Además de los distintos beneficios, el Presidente de la República les ha ofrecido a los inversionistas extranjeros, que pretendan explotar esta moneda a través de inversiones que impulsen la economía del país, distintos incentivos en cuanto a la obtención de diferentes estatus y figuras migratorias; siendo las más atractivas, la obtención de una residencia por poseer bitcoin así como la nacionalización para estos inversionistas; proceso migratorio bastante complejo y reservado para un grupo muy selectos de personas, específicamente para centroamericanos y españoles.
Sin embargo, hasta el momento no se han establecido lineamientos claros, instructivos o reglamentos y leyes que regulen este tipo de beneficios migratorios. Aunque constantemente se hace alusión a dichos incentivos, las autoridades migratorias y la Dirección General de Migración y Extranjería de El Salvador se encuentra trabajando en los requisitos y regulaciones así como el trámite pertinente a seguir para poder optar a estas figuras migratorias.
Habiéndose establecido lo anterior, la falta de lineamientos claros para la obtención de estos incentivos migratorios, no ha mitigado el deseo, interés o incluso la inversión en si encaminada a la utilización y explotación de esta criptomoneda. Desde que el presidente lo dio a conocer por medio de cadena nacional, distintas entrevistas y tweets así como desde la entrada en vigencia de la “Ley de Bitcoin”, se ha notado un crecimiento e interés evidente sobre el país en temas relacionados al Blockchain, Fintech y el uso y explotación de las criptomonedas en general, haciéndose un claro énfasis en el bitcoin.
Si bien, de acuerdo a lo establecido anteriormente, aún no está regulada la figura de una residencia por la tenencia y uso de bitcoin, aún existen distintos tipos de figuras migratorias a las que un extranjero pudiese llegar a aplicar en caso de tener ya sea el deseo, interés o la necesidad de residir en el país para explotar esta criptomoneda.
