La reversa de EE UU en las negociaciones sobre flujo transfronterizo de datos

El 25 de octubre Estados Unidos anunció su determinación de retirar la propuesta que había presentado, ante la Organización Mundial del Comercio (OMC) en el año 2019, relacionada con la regulación del flujo de datos trasfronterizo.
Katherine Tai, representante de ese país ante la OMC, notificó la decisión durante la última sesión de trabajo sobre la regulación del comercio electrónico, que se llevó a cabo en el seno de esa organización, y explicó que ella obedeció a la necesidad de permitir, al Congreso Estadounidense, un amplio margen para regular el manejo de datos por parte de las grandes compañías de tecnología (Big Tech).
Lo anterior, en aras de proteger el interés público y de combatir los comportamientos contrarios a la competencia de común ocurrencia en el ámbito de la economía digital.
La iniciativa que ahora se retira había sido presentada por la administración de Donald Trump, y buscaba que las normas de comercio electrónico de la OMC garantizaran la libre circulación trasfronteriza de datos (CTD), y evitar que los gobiernos exigieran o establecieran obstáculos y requisitos nacionales a la localización de datos, especialmente los datos personales, valiéndose de argumentos relativos a la privacidad y la seguridad nacional.
Según el Consejo Económico y Social de las Naciones Unidas (ECOSOC), la CTD supone que la circulación de datos e información fluya a través de las fronteras nacionales para que sea procesada, almacenada y recuperada en otro país.
Ello trae, entre otros beneficios, la libre comunicación de mensajes y opiniones, refuerza libertad de expresión, al igual que fomenta el progreso técnico y la innovación.
Para el Banco Mundial, la CTD ocupa un papel cada vez más importante, no solo en el desarrollo del comercio internacional de bienes, sino en el de servicios digitales, además de que contribuye a una mayor eficiencia en esas operaciones.
