El Salvador: Nuevas tendencias de la función notarial.

El 2022 finalizó con la aprobación de Reformas a la Ley de Notariado por parte de la Asamblea Legislativa. Estas reformas aún se encuentran en proceso de formación de ley, esperando al veto del órgano ejecutivo, y las que se esperaba que entraran en vigor el pasado 1 de enero de 2023. Esta reforma está compuesta por 14 artículos, de los cuales emanan nuevas obligaciones para los notarios, así como la obligatoriedad de otras, que a pesar de que se encontraban en la ley, por costumbre, no todos los notarios las cumplían.
Con relación a la Reforma a los artículos 23 y 24 de la Ley del Notariado, se ha generado incertidumbre en la manera de cómo se aplicará en el día a día del ejercicio notarial. Dentro de las reformas, lo más significativo es la manera en que se presentarán los libros de protocolo y otros documentos notariales a La Sección de Notariado, ya que no solamente se digitalizará el libro de Protocolo de los notarios, sino que también los legajos de anexos de éste, y las actas notariales, resultando obligatorio que a partir de este año el almacenamiento y presentación de los mencionados documentos será de una manera digital.
Del análisis de las reformas a la Ley de Notariado se detecta un vacío de ley, ya que en el caso de la digitalización de los libros de Protocolo, tantos los agotados como los vencidos, su legajo de anexos, y las actas notariales, la mencionada Reforma omite indicar la forma del almacenamiento de los documentos electrónicos, dejando en manos del notario la decisión de cómo almacenar los mencionados documentos, pudiendo el notario decidir almacenarlo por sus propios medios (discos duros externos, sus computadoras, etc.) o contratar el servicio de plataformas especializadas para el almacenamiento de documentos digitales. Por lo tanto, haciendo una relación con la Ley de Firma Electrónica respectivamente en sus artículos 12 y 13, los notarios deberán de guardar los documentos digitales por medio de un proveedor de almacenamiento de documentos electrónicos, mismos que siempre constarán de manera física o por escrito tales como el libro de protocolo, los anexos de este y las Actas Notariales.
En relación a la reforma del Artículo 53 de la Ley de Notariado, se reitera la obligación notarial de presentar una copia de las actas notariales a la Sección de Notariado, y que, en virtud de la reforma, este año el Notario deberá, de manera obligatoria, extender...
