En los autos "Fax S.A. c/ Alba Compañía Argentina de Seguros S.A. s/ ordinario" la actora había tomado un seguro de crédito con la demandada para cubrir las pérdidas definitivas que pudiera sufrir por la insolvencia de C.B. S.A., uno de sus clientes.
A Fax le rechazaron cheques de C.B., por lo que lo intimó a que pague esas sumas bajo apercibimiento de pedirle la quiebra.
Ante el silencio de C.B., Fax denunció el incumplimiento a su aseguradora, indicando que la semana siguiente pediría la quiebra de C.B. Días después de la denuncia, la aseguradora solicitó a Fax más información respecto del reclamo, quien suministró la información varios meses después, aunque no suministró el auto de quiebra o concurso preventivo de C.B.
Cuando habían pasado más de treinta días desde que Fax presentó esta documentación, la aseguradora demandada rechazó el reclamo. Los motivos del rechazo fueron que no se había configurado el siniestro y que se habían verificado supuestos de caducidad.
En primera instancia se condenó a la aseguradora, entendiendo que el rechazo del reclamo había sido extemporáneo.
La Cámara revocó el fallo de primera instancia. Al hacerlo, señaló que el seguro de crédito garantiza el riesgo de "pérdida definitiva", total o parcial, del valor del crédito por insolvencia del deudor. La insolvencia del deudor, según dijo el tribunal, se debe manifestar en la forma taxativamente precisada en la póliza.
La póliza preveía que ante la amenaza de insolvencia, el asegurado se obligaba a realizar distintas medidas; entre ellas, cursar un aviso de amenaza de siniestro al asegurador dentro de los tres días hábiles de la falta de pago del crédito a contar desde el vencimiento inicial o su prórroga.
Por otra parte, la póliza disponía que para que hubiera insolvencia debía mediar auto firme declarando la quiebra del deudor o, cuando existiendo elementos de juicio que en forma indubitable y a satisfacción del asegurador indicaran que el crédito resultaba incobrable, resultara dispendioso iniciar o continuar trámites judiciales tendientes al cobro.
