SII imparte instrucciones sobre nueva definición de residente y domicilio tributarios

El pasado 25 de noviembre, el Servicio de Impuestos Internos (SII) publicó la Circular N° 63 que imparte instrucciones sobre operatoria de la nueva definición de residencia tributaria y de su articulación con el concepto de domicilio.
A continuación, mencionamos 10 puntos relevantes:
- La adquisición de residencia tributaria en Chile requiere estar físicamente en el país al menos 184 días, ininterrumpidos o no, en un periodo de 12 meses consecutivos y móviles. Para el cómputo de ese plazo, se incluyen los días de entrada y salida, pero no los días transcurridos “en tránsito”.
- Una persona será considerada residente para efectos tributarios a partir de la fecha en que cumpla los 184 días, por lo que salvo que adquiera domicilio antes del cumplimiento de ese plazo, será considerada no residente por esos 183 días iniciales.
- La ley en la práctica tiene efecto retroactivo, ya que obliga a contar el plazo de 184 días desde la fecha de su publicación (1 de marzo de 2020) hacia atrás.
- La pérdida de domicilio no implica necesariamente la pérdida de residencia tributaria. Por regla general, quien pierda su domicilio tributario seguirá siendo residente tributario en Chile hasta que se cumpla el plazo de 184 días, aunque adquiera residencia o domicilio tributario en el extranjero antes de dicho plazo.
- Los miembros de una familia que se muda al extranjero no perderán su domicilio tributario en Chile si “conservan en Chile en forma directa o indirecta, el asiento principal de sus negocios”, sin importar el número de días que se ausenten del país ni que su “centro de intereses vitales” se encuentre en el extranjero.
